For the purpose of this agreement, “Music2Deal” refers to the service/s provided by the online platform Music2Deal.com as well as any other services provided in person by an authorised employee or contractor of Music2Deal or a third party affiliate of Music2Deal such as its associate company Music2Deal D&D UG (haftungsbeschränkt).
Preamble
By logging on to Music2Deal.com and/or any of its partner sites – you accept the following General Terms and Conditions for using Music2Deal. The user (in the following defined as “MEMBER” (singular) or “MEMBERS” (plural) enters into this agreement for the use of services provided by Music2Deal e.k., Rappstr. 2, 20146 Hamburg, Germany.
Additional contact information is available on the commercial registry data which can be found under imprint. The name of the authorized representatives of Music2Deal can be found under “Contact” by selecting the corresponding location.
The services or a bunch of services provided by Music2Deal are intended exclusively for persons of legal age who are working with music in the broadest sense (or who have something to do with music in a professional way in the broadest sense). The MEMBER can call up, print out, download and/or save these General Terms and Conditions at any time, even after the agreement has been closed, under the “Terms & Conditions” link that appears on all Music2Deal pages.
We may revise these terms of use at any time by amending this page. These Terms and Conditions were last updated on 24th April 2019. Please check this page from time to time to take notice of any changes we make, as they are binding on you.
1. Subject Matter
Music2Deal offers the registered MEMBERS a business platform on the Internet that connects the members with other members and helps them to communicate about their business, their business interests which could include but is not limited to their offers and their wants. Music2Deal merely provides the MEMBERS with a platform which helps them establish contact with other MEMBERS and communicate about their offers and wants. Music2Deal only provides technical applications which allow MEMBERS to contact one another.
1.1 With regards to the content or context of the communication between the members, Music2Deal does not participate to either understand or store the knowledge of such communication between the MEMBERS.
1.2 If the MEMBERS enter into agreements (with or without the knowledge of Music2Deal) with one another over Music2Deal or offsite or in private, Music2Deal shall not be a contracting party to such agreements. The MEMBERS are responsible for the execution and/or fulfilment of agreements which they enter with one another. Music2Deal shall not be held liable if MEMBERS are unable to contact one another over Music2Deal regarding such agreements.
1.3 Furthermore, Music2Deal shall not be liable for breaches of duty in relation to agreements entered into between MEMBERS with one another.
1.4 The MEMBER acknowledges and agrees that it is technically impossible to achieve 100% availability of Music2Deal. Music2Deal shall nonetheless endeavour to keep Music2Deal.com available without interruption. Events related to maintenance, security or capacity requirements, and/or events beyond Music2Deal’s control (e.g. disruptions in public communication networks, power failures etc.), may result in brief malfunctions or temporary interruptions of the services provided on Music2Deal.
1.5 Even when Music2Deal is available it does not guarantee that the website, or any content on it, will always be available or be uninterrupted.
1.6 Access to the website is permitted on a temporary basis only. Music2Deal may suspend, withdraw, discontinue or change all or any part of the website without notice to the Member.
1.7 Music2Deal will not be liable to the Member if for any reason the website or any of its content is unavailable at any time for any amount of period.
1.8 The website – Music2Deal.com may be accessed by any computer device, including mobile and tablet devices. The website is designed and tested with most commonly available modern browsers, however some of the website features and functionalities may not be compatible with older or certain browser types as well as with certain mobile devices and/or tablets.
1.9 With a membership on Music2Deal the member will by default receive a regular newsletter as well as other notifications concerning their membership (e.g.: statistics). The user can unsubscribe from the newsletter by clicking on the “unsubscribe” link in the newsletter. The user can also unsubscribe from all notifications on the “Settings” tab provided to the user on his/her Music2Deal profile.
1.10 Group moderators on Music2Deal are entitled to choose their members. They may freely choose whether or not a MEMBER may join their group.
1.11 Any use of the services and contents offered on Music2Deal beyond the scope of options/features provided by Music2Deal requires the prior written consent of Music2Deal.
1.12 Music2Deal shall make available to other third parties the data and/or information provided by the MEMBER in such manner that the data and/or information does not violate any laws or these General terms and conditions.
1.13 Music2Deal is entitled to remove any illegal or prohibited data and/or information from Music2Deal without any prior notice to the MEMBER.
2. Registration
2.1 MEMBERS must register prior to using Music2Deal.
2.2 The MEMBER warrants and represents that all of his/her data which he/she provided for registration is true, accurate and complete. If an error is detected or if there is a change in circumstances, then the MEMBER shall report any such errors or changes in the registration data to Music2Deal without any undue delay.
2.3 The MEMBER warrants and represents that he or she is of legal age and working with the music business or music in the broadest sense (i.e. – he/she has something to do with music in a professional way within a broad context) at the time of registration.
2.4 The MEMBER shall choose a password upon registration. The MEMBER is obliged to keep this password secret. Music2Deal shall not disclose the password to any third party unless otherwise required specifically by a legal court order or under any other form of a legal obligation or to meet a particular legal compliance/s.
2.5 By completing the registration process, the MEMBER consents to enter the agreement to use the services of Music2Deal. Music2Deal counter consents to this agreement by activating the membership of the member for the use of services on Music2Deal. The conclusion and execution of the agreement takes effect with the aforementioned acceptance by Music2Deal.
2.6 Each MEMBER is entitled to register with Music2Deal only once, and the MEMBER may only establish one (1) MEMBER profile.
2.7 It is technically not possible for Music2Deal to determine with certainty whether any MEMBER registered with Music2Deal is in fact the real person that he or she purports to be. Therefore, music2deal assumes no liability for the actual identity of a MEMBER. Each MEMBER is solely responsible for cross checking and doing the required due diligence to check the actual identity of the other MEMBER he/she wants to communicate with.
3. Memberships, Credits & Payments
3.1 A registered MEMBER will always start with a basic membership unless decided independently by Music2Deal at its own discretion. A basic membership is free to use however a basic membership does not allow the member to use all the features of Music2Deal.
3.2 Once the member is comfortable with a basic membership, he/she can then upgrade to one of the various available Premium Memberships. Premium Memberships have different price bands from which the member can as per his/her needs choose any one.
3.3 With the Basic Membership, the member can for FREE access (and listen to) the music offers and wants uploaded by other members on music2deal. The basic member can also upload one music offer, up to 10 wants, display their own profile and lastly communicate with other users.
3.4 A basic membership is for FREE whereas the premium memberships are offered at different price bands which have to be paid with credits. Credits are comparable to an internal currency which the Music2Deal system uses because of the ease of application as well as scalability of the technology tools. The fees and the exchange rates for the Credits listed under the pages “Prices”, “Upgrade” and “My Account” are binding.
3.5 Fees may be different for each territory. A MEMBER must pay the fees for the territory in which hr/she lives and/or are registered from – as a location on Music2Deal. They can´t pay a different territory’s fee and must abide to the fees as displayed to them on the system. In case there is no contract for the MEMBER’s country, the contract will be effective from the country or area which is responsible for the country where the MEMBER lives. If there is no country in Music2Deal.com responsible for the MEMBER than the German contract will be effective by default.
3.6 MEMBERS can buy credits using conventional payment methods such as credit cards or debit cards or online systems as stipulated by Music2Deal from time-to-time. Music2Deal reserves the right to innovate and apply futuristic payment methods such as cryptocurrency, digital currency, etc.
3.7 MEMBERS can also earn credits by voting for music uploaded by other members, being voted by other members (for music offers uploaded by the members themselves) or by inviting music industry friends to their network on Music2Deal. The registration of Music Industry friends invited by the members are accepted by Music2Deal keeping in line with the general criteria of membership acceptance set out in the Music2Deal Internal Policy on Acceptance of Members.
3.8 Unused credits bought OR earned by the member expire 24 months after the date of purchase or earning. The expiry date of credits is noted by default on the system and the member will be unable to change this for any reason whatsoever.
3.9 Credits are non-refundable into other currencies at any time except for situations where credits are purchased yet are unused due to an acceptable reason. Such credits can be refunded within 14 days of the invoice date. All refund requests must be submitted in writing by letter, email or through our contact page citing an acceptable reason.
3.10 A member can upgrade or downgrade his membership at any time using the tab “My Account” within the member’s profile page. By downgrading to a lower membership, the corresponding purchased or earned Credits will be subtracted from the current Credits of a Member as per the proportionate amount of credits mentioned.
3.11 There is no term for Basic and the Premium Membership plans. The Premium Membership plan automatically ends if there are not enough Credits. In case the member does not purchase or earn enough credits to keep the Premium Membership going then in that case, the premium membership becomes a Basic Membership plan.
3.12 The memberships with their corresponding featured and the prices can call up, print out, download and or save at any time under the “Rates” link that appears on all Music2Deal pages.
3.13 Invoices will be available to the MEMBER when he/she clicks on “My Account” tab and further clicks “Payments”. All invoices will be made available for a period of one (1) year from the date of invoicing.
Payments for the Premium Membership shall be due immediately upon invoicing. Payment can be made using the various payment processes available
i.e. – Via the accepted credit cards, or the available online payment systems. If Music2Deal is unable to collect fees from an account designated by the MEMBER due to lack of funds, the MEMBER shall bear all costs arising from as well as including but not limited to just bank charges, related to any debit entries or similar charges, insofar as the MEMBER is responsible for the event that triggers these costs. In case of a transfer from foreign countries the MEMBER pays the full expenses of the transfer costs.
4. Right of cancellation
4.1 The MEMBER may cancel registration for the Basic or Premium Membership in writing (e.g. by letter or e-mail) within two (2) weeks without stating a reason. The 2-week period begins when the membership is activated by Music2Deal.
4.2 The MEMBER may cancel registration for the Premium Membership in writing (e.g. by post or e-mail) within two (2) weeks without stating a reason, after changing from Basic Membership to Premium Membership. The 2-week period begins when Premium Membership is activated by Music2Deal.
4.3 For meeting the cancellation deadline in each of the abovementioned cases, the date of dispatch of the cancellation notice is decisive.
In each of the abovementioned cases, the cancellation notice should be sent by post to Music2Deal e.k., Rappstr. 2, 20146 Hamburg, Germany.
The MEMBER may also deliver notice of termination using the contact form available on most Music2Deal pages, or by sending an e-mail to [email protected]
The MEMBER’s right of termination under section 8 shall not be affected by the MEMBER’s cancellation right under the section 3.
Premature lapse of the right of cancellation –
4.4. The MEMBER’s right of cancellation lapses before the end of the right of cancellation period if Music2Deal has begun performing the Music2Deal services for which the MEMBER is registered with the express consent of the MEMBER, or if the MEMBER has initiated the Music2Deal services for which the MEMBER is registered (e.g. in which the MEMBER has accessed the Music2Deal services that Music2Deal has made available to the MEMBER in accordance with the type of Membership chosen by the MEMBER). In the event of a valid cancellation, both parties shall be obliged to restore any benefits already received in accordance with legal provisions, and issue any gains (e.g. interest). If the MEMBER is not fully or partially able to restore the benefits, or only be able to restore them in poor condition, to Music2Deal, then the MEMBER must reimburse Music2Deal for the corresponding value.
4.5 The MEMBER must fulfil obligations for refunding within 30 days after dispatch of the cancellation notice.
5. Extent of Rights.
MEMBER transfers all necessary rights for the fulfilment of this contract to Music2Deal. This includes:
5.1 the partial or complete use of sound recordings in databases or datanets (i.e. internet, www, etc.), feeding into databases or nets, saving, distributing and making them available to MEMBERS of databases/nets through cable or other media of transmission for acoustic/visual perception and/or duplication.
5.2 the right to advertise and “bracket part analysis” (i.e. the authorization to use parts of the music2deal.com presentation, including the use of the name and picture of the title provider, for advertising purposes). The use of music, however, is only possible under the prerequisite of the MEMBER´s agreement.
6. Obligations of the MEMBER.
The MEMBER is obliged:
6.1 To provide only true and non-misleading statements in the MEMBER profile and in communications with other MEMBERS;
6.2 That their provided material is not being restricted in terms of copyright. That such material does not violate any other person’s rights. That such material is permissible to be uploaded on Music2Deal.com and does not need the authorization of any particular law making body or society or agency (e.g. copyright, trademark, patent, utility patent, or design patent laws)
6.3 That the use of such material on Music2Deal does not violate any particular law with regards to advertising, promotions, offering for sale or distribution.
6.4 That all the data uploaded by the member as well as comments or the compositions and texts/lyrics do not contain any material which is offensive, obscene or in any way illegal;
6.5 The content uploaded by the member will not instigate actions with the intention of damaging Music2Deal including its infrastructure and functionality, particularly actions which may overload said infrastructure. This is particularly true by employing any mechanisms, software or scripts when using Music2Deal sites. The MEMBER is responsible for such data which is being uploaded to the Music2Deal.com website or provided otherwise to Music2Deal such that it does not disturb the Music2Deal website or data, nor the computer or data of Music2Deal’s other customers and MEMBERS, that it does not contain any viruses and is technically sound;
6.6 To not unreasonably annoy (particularly with spam) or engage in offensive or sexually oriented communication (explicit or implicit) with any other Music2Deal MEMBERS;
6.7 To not use or promote any commercial practices considered unfair competition, including progressive customer acquisition practices (such as chain distribution systems, multilevel selling, pyramid sales, email or messenger marketing to other members, etc);
6.8 To not do any blocking, overwriting, modifying and/or copying of any content of Music2Deal, unless said actions are necessary for the proper use of the services on Music2Deal;
6.9 To not do any distribution or public disclosure of the contents of the Music2Deal Web Site as well as the website of that of any other MEMBER;
6.10 To not use any insulting or defamatory content, regardless of whether the said content is directed at another Member or Music2Deal’s personnel or other companies;
7. Warranty, Liability and Indemnity
7.1 Music2Deal is liable for any damage only in the case of intentional and culpable negligence. Liability is restricted to the damage predictable at the time of contracting.
7.2 Music2Deal is not liable for:
any delay in respect of uploading (upgrading, price changes, or payment) economic losses (arising out of or in connection with this agreement) damage of reputation or loss of goodwill
7.3 Neither party is liable for any violation of this contract caused by force majeure, including (but not limited to) terrorism, fire, accident, civil war, government action, failure of power supply, network failure, strike, lock out, and default or failure of a subcontractor or supplier.
7.4 Music2Deal does not make any warranties or representations regarding any data and/or information provided or made available by any MEMBER on Music2Deal as well as on any external websites linked to them. In particular, Music2Deal does not warrant or represent that the said data and/or information is true or accurate, or that it fulfils or serves any particular purpose whatsoever. Music2Deal encourages members to deploy their own due diligence.
7.5 The MEMBER shall indemnify and exempt Music2Deal from all actions, including damage claims, asserted by other MEMBERS or third parties against Music2Deal resulting from an infringement of their rights by the content posted by the MEMBER on Music2Deal. Additionally, the MEMBER shall indemnify and exempt Music2Deal from all actions, including damage claims, asserted by other MEMBERS or third parties against Music2Deal resulting from an infringement of their rights regarding the use of the services of Music2Deal by the MEMBER. The MEMBER assumes all reasonable costs Music2Deal incurs due to an infringement of third party rights, including all reasonable legal-defence costs. All other rights, including damage claims by Music2Deal, are hereby unaffected. The aforementioned obligations shall not apply to the extent the MEMBER is not responsible for the infringement.
7.6 In the event the content posted by the MEMBER infringes any rights of any third party, the MEMBER shall, at its own expense and at Music2Deal’s discretion, either obtain the right to use the said content or render said content free of any infringement. In the event the MEMBER infringes third-party rights when using the services of Music2Deal, the MEMBER shall discontinue such use that violates these General Terms and Conditions and the law, if so requested by Music2Deal. The MEMBER may report any activities of any other MEMBER which violate applicable laws and/or any of the terms and conditions of these General Terms and Conditions using the contact form available on most Music2Deal pages.
7.7 Changes to the Services of Music2Deal – Music2Deal reserves the right to modify its services and/or to offer services different from those offered at the time of the MEMBER’s registration at any time, unless this is unreasonable for the MEMBER.
8. Termination of Membership and Reimbursement of Advance Payments
8.1 The MEMBER may terminate the Membership at any time without a cause. The MEMBER may deliver notice of termination using the contact form available on most Music2Deal pages or by sending an e-mail to [email protected] at any time. The termination notice shall include the MEMBER’s registered name and an e-mail address of the MEMBER registered on the Music2Deal Web sites.
8.2 After the member has initiated the cancellation process of the contract, Music2Deal may ask the member one last time about the reason for the cancellation. The reason for this is just to be sure that the member really wants to cancel his/her membership. On initiating the cancellation process the member acknowledges that deleting the members’ account will result in a permanent deletion of all existing data of the member on Music2Deal. The member also acknowledges and agrees that such data cannot be recovered back for any reason whatsoever.
8.3 A good cause is defined as an event which makes it unacceptable for Music2Deal to continue the agreement to the end of the termination period, taking into account all circumstances of the individual case and weighing the interests of Music2Deal against the MEMBER’s. A good cause includes any of the following events:
If the MEMBER fails to comply with any applicable legal provisions If the MEMBER breaches a contractual obligation, in particular an obligation set forth in sections 2 and 5 of these General Terms and Conditions. If the reputation of Music2Deal is substantially impaired by the online presence of the MEMBER If the MEMBER causes harm to any other MEMBER(s) by any means whatsoever.
8.4 In the event of a good cause in accordance with notwithstanding Music2Deal’s right to terminate the contract and in accordance with section 8.3, Music2Deal is entitled to:
Delete the contents posted by the MEMBER Issue a warning, and/or Block the MEMBER’s access to the services on Music2Deal.
9. Privacy policy
Music2Deal recognizes that any data provided by the MEMBER to Music2Deal is important to the MEMBER, and Music2Deal shall therefore be particularly sensitive in handling all such data. Music2Deal shall comply with all applicable legal provisions regarding the data protection (German Data Protection Laws, European Data Protection Directives and any other applicable data protection legislation). In particular, Music2Deal shall not provide or otherwise disclose any personal data of the MEMBER to any third party without authorization. Details on Music2Deal’s treatment of the MEMBER’s data are set forth in the Privacy Policy Agreement of Music2Deal which is accessible from most of the Music2Deal pages. 10. Final Provisions
10.1 This contract and any modifications in addition must be made in writing to be valid. No secondary agreements exist.
10.2 Music2Deal reserves the right to amend these General Terms and Conditions at any time, without giving reasons, unless a modification is unreasonable to the MEMBER. In such an instance, Music2Deal shall give due notice of any modification of these General Terms and Conditions to the MEMBER.
If the MEMBER does not object to the applicability of the reworked General Terms and Conditions within two (2) weeks after receipt of said notice, the amended General Terms and Conditions shall be deemed to be accepted by the MEMBER. Music2Deal shall inform the MEMBER about the MEMBER’s right to object and of the relevance of the objection deadline in the said notice.
10.3 Unless otherwise agreed in these General Terms and Conditions, the MEMBER may submit all notices to Music2Deal by e-mail to [email protected] or by using the contact form provided on most of the Music2Deal pages or by letter. Music2Deal may send notices to the MEMBER by e-mail or post to the addresses given in the MEMBER’s current contact data in his or her MEMBER account.
10.4 Should any regulation contained in this contract be or become invalid or in case there is any gap in the contract, the legal validity of all other regulations will be maintained. In place of the voided regulation, a regulation shall be considered as valid which comes closest to the one chosen by the contracting MEMBERS; the same applies to a gap in the contract.
10.5 The place of performance under these General Terms and Conditions shall be Music2Deal’s main place of business.
10.6 Place of jurisdiction, as legally admissible, shall be the main place of business of Music2Deal – Hamburg, Germany.
10.7 These General Terms and Conditions and the contractual relationship shall be governed by the German Law, excluding international private law and the provisions of the United Nations Convention on Contracts for the International Sale of Goods that have been adopted by German Law.
10.8 Terms and Conditions on Data Protection of Music2Deal “Music2Deal” refers to the service provided subject to these General Terms and Conditions and/or Music2Deal e.k. and or its subsidiaries or associate companies. In these terms and conditions on data protection Music2Deal would like to inform you about how Music2Deal handles your personal data and how you can exchange this data with other MEMBERS of Music2Deal.

1. General Information
The 2nd International Zbigniew Seifert Jazz Violin Competition is organized by the Zbigniew Seifert Foundation.
The Competition is open to violinists, violists and cellists of all nationalities under the age of 38, performing jazz and improvised music. All types of violins and violas, both acoustic and electric, can be used.
The Competition is biennial (i.e. will be held every 2 years). The Organizer reserves the right to change the instrument or group of instruments to which the Competition will be dedicated in the future.
Winners of the First Prize in previous competitions are disqualified from re-entering.
2. Registration
The Organizer will register candidates on the basis of a carefully completed application form, available from the Organizer’s website at: www.seifertcompetition.com, in the folder “Application”. The following must be attached to the application:
– recordings of 3 music compositions in mp3 format (each file not larger than 20 MB);
– two photos of the candidate (min. 1 MB each);
– the candidate’s brief bio in English (max. 1500 characters).
The complete applications must be submitted via the Organiser’s website not later than 31st March 2016. The results of the preliminary round will be forwarded to all the candidates by 15th April 2016. Candidates qualified for the Competition cover the cost of a registration fee of €50 (50 Euros).
3. Repertoire Requirements
For the online preliminary round (the recordings attached to the application form), candidates may submit repertoire of their own choice.
Candidates qualified for the semifinals must perform the following program:
a. a composition by Zbigniew Seifert, selected by the candidate;
b. two pieces of the candidate’s own choice (own compositions can also be presented).
The obligatory program in the final round consists of:
a. a composition by Zbigniew Seifert, selected by the candidate;
b. two pieces of the candidate’s own choice (own compositions can also be presented).
ATTENTION!!! All the compositions selected by the candidates for the semifinals must be different from those presented in the finals.
The Organizer will accept solo performances without a rhythm section at every stage of the competition. A solo piece may also be submitted with the application form for the online preliminary round.
4. Prizes
The Organizer offers three Competition prizes:
– 1st prize – € 10.000
– 2nd prize – € 5.000
– 3rd prize – € 2.000
The final decision concerning the division of prizes among the winners is taken by the Competition Jury.
The winners are obliged to perform at the final concert (on 27thAugust 2016). Failure to fulfil this requirement is tantamount to breaking the Competition Regulations and will result in excluding the candidate and forfeiting the prize.
Special Award:
The special award of the 2nd Zbigniew Seifert Competition is a concert to be held on 16th December 2016 at the Witold Lutosławski Concert Studio of Polish Radio in Warsaw. The concert is organized by the Jazzarium Foundation – the Sponsor of the Award – as well as Polish Radio Channel Two, as part of the cycle “Jazzarium – The World Scene”. The Sponsor of the Award reserves the right to select the winner, who – with his or her band – will be invited to play the Concert. The Concert will be recorded and broadcast on Polish Radio Channel Two.
5. The Auditions
Auditions of the semifinal round will be held on Wednesday 24th and Thursday 25th August 2016. The final round, for which the jury will qualify 5 musicians, will be held on 26th August 2016. The order of performances will be decided by random draw and announced before the beginning of the semifinals. All the competition auditions are open for the audience to attend and streamed on-line.
6. Music Scores
The scores of compositions performed by candidates qualified for the auditions in Cracow must be submitted not later than 18th July 2016. The scores, with titles and names of composers, ought to contain performance notes and a lead sheet (the melody and the basic harmonic structure). Failure to fulfil this requirement will result in excluding the candidate.
7. The Organizer’s Obligations
The Organizer shall provide a concert hall complete with a sound system, lights and support services. The Organizer will also provide a rhythm section consisting of a piano, a double-bass and percussion, with which the qualified candidates will be able to rehearse before each performance. All the participants will perform with the same rhythm section.
The Organizer shall provide accommodation for candidates at the Krzysztof Penderecki European Centre for Music in Lusławice. Other costs, such as accommodation in Cracow, travel, boarding and (optionally) insurance must be covered by the participants at their own expense.
8. Final Provisions
Before the Competition, all the candidates shall sign an agreement with the Organizer.
The Organizer reserves the right to record all the Competition performances in audio/video format and use those recordings freely for the further promotion of the Competition.
The Organizer reserves the right to cancel the Competition in case the number of qualified candidates is not sufficient.
All the decisions taken by the Jury at all the stages (rounds) of the Competition are final and irrevocable.
The Organizer of the 2ndInternational Zbigniew Seifert Jazz Violin Competition reserves the right to decide about the final interpretation of the present Regulations.

Such media materials may be distributed in accordance with the provisions set out in this paragraph and can be found in the Press Room section. Publishing such media materials on Internet resources is considered acceptable if the User makes the appropriate reference “Photo/video credit: weplayholding.сom.” If the photo/video in question has a name in the website Press Room section, the name of the media materials in question must also be specified.
The User may not:
Make any changes to the media material that change or distort the actual essence of information about the persons, events, facts that are presented in the media materials.
Adapt, translate into other languages/dialects of the world, combine media materials together.
Use any bots or applications to search and/or extract information from the website.
Use the media materials for any commercial purposes (sale, sublicensing, exchange, as a contribution to the authorized capital, etc.), for advertising/sponsorship integration of product and service trademarks, actual third-party products/works/services, brand names, etc.

The User shall be responsible for infringing the Administrator’s intellectual property rights and/or for any infringement of third parties’ intellectual property rights.
To obtain authorization to use the media materials for any other purpose and/or under any other conditions, the User must contact the Administrator for written authorization.
All other intellectual property, including but not limited to trademarks, logos, names, commercial names, texts of news/publications/interviews, photos, images of individuals, graphic images, design, sketches, visual identity, etc., which are located on the website, but outside the Press Room section, belong by right of ownership or by right of use (according to the relevant License Agreements) to the Administrator and may not be used by Users in any way, regardless of the purpose of such use.
The website expressed in the objective form of a given computer code is also subject to intellectual property rights. All intellectual property rights to the website as an object of copyright belong to the Administrator. The User may not interfere with the computer code of the website in any way or try to damage the installed security systems. To restrict access to the website or certain content for Users from certain countries/jurisdictions under the local laws in force.
The Administrator shall:

Rights and Responsibilities of the User

If the Administrator, an employee or contractor of the Administrator, or any one of the Administrator’s affiliates receives a third-party claim regarding the User’s use of the media content or any other intellectual property primarily published on the website, the User shall settle such a dispute independently, without involving the Administrator, at their own expense, including involving professional legal assistance, and reimburse to it the possible expenses incurred due to its involvement in such a dispute.
Miscellaneous
The User Agreement shall be valid for an indefinite period starting from 1 May, 2021 and shall apply to all Users actually using the website.
This User Agreement is drawn up under the laws of the State of Delaware, the U.S., and the federal laws of the United States of America, without regard to any conflict of law/international private law principles.
Any disputes between the Administrator and the User that cannot be resolved through negotiation shall be referred for consideration and final settlement to a court of competent jurisdiction in the State of Delaware, the U.S.
If a court declares any part (Paragraph and/or Section) of this User Agreement to be invalid, the invalidation of such part shall not entail the automatic invalidation of any other provisions of the User Agreement.
If the Administrator fails to exercise any rights under this User Agreement, such failure to exercise a right shall in no way be deemed a waiver thereof.
The numbering of items and sections is intended for convenience only, and any technical typo when referring to a particular Paragraph/Section shall be disregarded for construing the terms and conditions of the User Agreement and shall not affect the actual legal relationship between the Administrator and the User.

– Manipulating play counts, downloads, ratings, or reviews via any means — such as (i) using a bot, script, or automated process; or (ii) providing or accepting any kind of compensation or incentive — is prohibited.
– It is your responsibility not to lose, destroy, or damage Content once downloaded. We encourage you to back up your Content regularly.
– You may not tamper with or circumvent any security technology included with the Services or Content.
– You may access our Services only using Apple’s software, and may not modify or use modified versions of such software.
– Video Content requires an HDCP connection.
Audio and Video Content Sales and Rentals:
– You can use Digital Rights Management (DRM)-free Content on a reasonable number of compatible devices that you own or control. DRM-protected Content can be used on up to five computers and any number of devices that you sync to from those computers.
– Content rentals are viewable on a single device at a time, and must be played within 30 days, and completed within 48 hours of the start of play (stopping, pausing or restarting does not extend this period).
– You may burn an audio playlist of purchased music to disc for listening purposes up to seven times; this limitation does not apply to DRM-free Content. Other Content may not be burned to disc.
– Purchased Content will generally remain available for you to download, redownload, or otherwise access from Apple. Though it is unlikely, subsequent to your purchase, Content may be removed from the Services (for instance, because the provider removed it) and become unavailable for further download or access from Apple. To ensure your ability to continue enjoying Content, we encourage you to download all purchased Content to a device in your possession and to back it up.
App Store Content:
– The term “Apps” includes apps and App Clips for any Apple platform and/or operating system, including any in-app purchases, extensions (such as keyboards), stickers, and subscriptions made available in such apps or App Clips.
– Individuals acting on behalf of a commercial enterprise, governmental organization or educational institution (an “Enterprise”) may download and sync non-Arcade Apps for use by either (i) a single individual on one or more devices owned or controlled by an Enterprise; or (ii) multiple individuals on a single shared device owned or controlled by an Enterprise. For the sake of clarity, each device used serially or collectively by multiple users requires a separate license.
Apple Music:
– An Individual Apple Music membership allows you to stream on a single device at a time; a Family membership allows you or your Family members to stream on up to six devices at a time.
Apple Arcade:
– Apple Arcade Apps may only be downloaded, or redownloaded, with a valid Apple Arcade trial or subscription.
– If your subscription ends, Apps downloaded via Apple Arcade will no longer be accessible to you.
Apple TV Content:
– For most channels, you can stream video Content on up to three devices simultaneously.

DOWNLOADS
You may be limited in the amount of Content you may download, and some downloaded Content may expire after a given amount of time after downloaded or first played. Certain Content may not be available for download at all.
You may be able to redownload previously acquired Content (“Redownload”) to your devices that are signed in with the same Apple ID (“Associated Devices”). You can see Content types available for Redownload in your Home Country at https://support.apple.com/HT204632. Content may not be available for Redownload if that Content is no longer offered on our Services.
Content also may be removed from our Services at any time (for instance, because the provider removed it), after which it cannot be downloaded, redownloaded, or otherwise accessed from Apple.
SUBSCRIPTIONS
The Services and certain Apps may allow you to purchase access to Content or Services on a subscription basis (“Paid Subscriptions”). Paid Subscriptions automatically renew until cancelled in the Manage Subscriptions section of your account settings. To learn more about cancelling your subscriptions, visit https://support.apple.com/HT202039. You will be notified if the price of a Paid Subscription increases and, if required, your consent will be required to continue. You will be charged no more than 24 hours prior to the start of the latest Paid Subscription period. If we cannot charge your payment method for any reason (such as expiration or insufficient funds), and you have not cancelled the Paid Subscription, you remain responsible for any uncollected amounts, and we will attempt to charge the payment method as you may update your payment method information. This may result in a change to the start of your next Paid Subscription period and may change the date on which you are billed for each period, as displayed on your receipt. We reserve the right to cancel your Paid Subscription if we are unable to successfully charge your payment method to renew your subscription. Certain Paid Subscriptions may offer a free trial prior to charging your payment method. If you decide to unsubscribe from a Paid Subscription before we start charging your payment method, cancel the subscription at least 24 hours before the free trial ends.
If you start a free trial to a Paid Subscription offered by Apple as Content provider (an “Apple Paid Subscription”) and cancel before it ends, you cannot reactivate the free trial.
Free trials or free offers to Apple Paid Subscriptions, excluding iCloud, cannot be combined with any free trials or offers of Apple One. If you are in a free trial or free offer for any Apple Paid Subscriptions, and you subscribe to Apple One, your free trial(s) or offer(s) will not be paused even if you have access to such Apple Paid Subscription(s) through your Apple One subscription. You acknowledge that your free trial or free offer may expire while you are a Paid Subscriber to Apple One, and Apple shall have no obligation to reinstate, reimburse, or otherwise compensate you for any part of such expired free trial or free offer.
When your Paid Subscription to any Service or Content ends, you will lose access to any functionality or Content of that Service that requires a Paid Subscription.
CONTENT AND SERVICE AVAILABILITY
Terms found in this Agreement that relate to Services, Content types, features or functionality not available in your Home Country are not applicable to you unless and until they become available to you. To see the Content types available to you in your Home Country, go to the Services or visit https://support.apple.com/HT204411. Certain Services and Content available to you in your Home Country may not be available to you when traveling outside of your Home Country.
THIRD-PARTY DEVICES AND EQUIPMENT
You may not be able to use all features of the Services when accessing them on a non-Apple-branded device. Additionally, certain Services may require, direct, or suggest you use third-party equipment in some circumstances and/or for certain activities; such use is subject to the terms and conditions of such equipment and should be made in accordance with the applicable manufacturer’s instructions. By using the Services, you agree that Apple may automatically download and install minor updates to its software on third-party equipment from time to time.
C. YOUR SUBMISSIONS TO OUR SERVICES
Our Services may allow you to submit or post materials such as comments, ratings and reviews, pictures, videos, and podcasts (including associated metadata and artwork). Your use of such features must comply with the Submissions Guidelines below, which may be updated from time to time, and if we become aware of materials that violate our Submission Guidelines we will remove them. If you see materials that do not comply with the Submissions Guidelines, please use the Report a Concern feature. Except to the extent prohibited by law, you hereby grant Apple a worldwide, royalty-free, perpetual, nonexclusive license to use the materials you submit within the Services and related marketing as well as to use the materials you submit for Apple internal purposes. Apple may monitor and decide to remove or edit any submitted material.
Submissions Guidelines: You may not use the Services to:
– post any materials that (i) you do not have permission, right or license to use, or (ii) infringe on the rights of any third party;
– post objectionable, offensive, unlawful, deceptive, inaccurate, or harmful content;
– post personal, private or confidential information belonging to others;
– request personal information from a minor;
– impersonate or misrepresent your affiliation with another person, or entity;
– post or transmit spam, including but not limited to unsolicited or unauthorized advertising, promotional materials, or informational announcements;
– post, modify, or remove a rating or review in exchange for any kind of compensation or incentive;
– post a dishonest, abusive, harmful, misleading, or bad-faith rating or review, or a rating or review that is irrelevant to the Content being reviewed;
– plan or engage in any illegal, fraudulent, or manipulative activity.
D. FAMILY SHARING
The organizer of a Family (“Organizer”) must be 18 years (or the equivalent age of majority in your Home Country) or older and the parent or legal guardian of any Family member under age 13 (or the equivalent minimum age in their Home Country as set forth in the registration process). Apple devices are required for access to all of the Family Sharing features. Family Sharing allows eligible subscriptions to be shared among up to six members of a Family. Purchase Sharing: Family Sharing’s Purchase Sharing feature allows eligible Content to be shared among up to six members of a Family. The Organizer invites other members to participate, and agrees to pay for all Transactions initiated by Family members. The Organizer’s eligible payment methods are used to pay for any Transaction initiated by a Family member (except when the Family member’s account has store credit, which is always used first). Family members are acting as agents for the Organizer when the Organizer’s eligible payment methods are used. The Organizer hereby agrees (1) to pay for such Transactions; (2) that Transactions initiated by Family members are authorized; and (3) Transactions will be charged to eligible payment methods in the manner indicated in Section B above. Organizers are responsible for complying with their payment method contracts, and assume all risk related to sharing access to their eligible payment methods with Family members. A receipt or invoice for any Family member Transaction is sent to the initiating Family member and, if billed to the Organizer’s payment method, also to the Organizer.
Ask to Buy: Ask to Buy is a feature that allows an Organizer to approve Transactions initiated by a Family member under age 18 (or the equivalent age of majority in your Home Country). Content shared by Family members or acquired via content codes generally is not subject to Ask to Buy; content codes facilitating access to subscriptions are subject to Ask to Buy. The Organizer must be the parent or legal guardian of any Family member for whom Ask to Buy is activated. Ask to Buy is enabled by default for any Family member under the age of 13 (or the equivalent minimum age in their Home Country) and stays on until deactivated by the parent or legal guardian. If Ask to Buy is turned off after the Family member turns 18 years old, it cannot be turned on anymore. Ask to Buy does not require Purchase Sharing to be enabled.
Family Member changes: When a Family member leaves or is removed from the Family, the remaining Family members may no longer be able to access the former member’s Content, including Content acquired with the Organizer’s payment method.
Family Sharing Rules: You can only belong to one Family at a time, and may join any Family no more than twice per year. You can change the Apple ID you associate with a Family no more than once every 90 days. All Family members must share the same Home Country. Not all Content, including In-App Purchases, subscriptions, and some previously acquired Apps, are eligible for Purchase Sharing. Apple TV+, Apple TV Channels, Apple One Family, Apple One Premier, Apple Music Family, Apple Arcade, Apple News+, and Apple Fitness+ subscriptions are automatically enabled for Family Sharing. Subscriptions shared by a Family may be subject to Content usage limitations on a per subscription basis.
E. SEASON PASS AND MULTI-PASS
A Pass allows you to purchase and receive television Content as it becomes available. A Season Pass applies to television Content that has a limited number of episodes per season; a Multi-Pass applies to television Content that is available on an ongoing basis. The full price of a Season Pass or Multi-Pass is charged at the time of the Transaction. Season Pass or Multi-Pass Content is available for download up to 90 days after the last episode becomes available. If a Content provider delivers to Apple fewer TV episodes than planned when you purchased a Season Pass, we will credit to your Apple ID the retail value of the corresponding number of episodes that were not provided to Apple.
F. ADDITIONAL APP STORE TERMS (EXCLUDING APPLE ARCADE APPS)
LICENSE OF APP STORE CONTENT
App licenses are provided to you by Apple or a third party developer (“App Provider”). Apple acts as an agent for App Providers in operating the App Store and is not a party to the sales contract or user agreement between you and the App Provider. However, if you are a customer of Apple Distribution International Ltd., the merchant of record is Apple Distribution International Ltd., which means that you acquire the App license from Apple Distribution International Ltd., but the App is licensed by the App Provider. An App licensed by Apple is an “Apple App;” an App licensed by an App Provider is a “Third Party App.” Any App that you acquire is governed by the Licensed Application End User License Agreement (“Standard EULA”) set forth below, unless Apple or the App Provider provides an overriding custom license agreement (“Custom EULA”). The App Provider of any Third Party App is solely responsible for its content, warranties, and claims that you may have related to the Third Party App, subject to local law. You acknowledge and agree that Apple is a third-party beneficiary of the Standard EULA or Custom EULA applicable to each Third Party App and may therefore enforce such agreement. Certain Apps, such as stickers and iMessage apps, may not appear on the device springboard but can be accessed and used in the Messages app drawer.
IN-APP PURCHASES
Apps may offer content, services or functionality for use within such Apps (“In-App Purchases”). In-App Purchases that are consumed during the use of the App (for example, virtual gems) cannot be transferred among devices and can be downloaded only once. You must authenticate your account before making In-App Purchases – separate from any authentication to obtain other Content – by entering your password or using Touch ID or Face ID. You will be able to make additional In-App Purchases for fifteen minutes without re-authenticating unless you have asked us to require a password for every purchase or have enabled Touch ID or Face ID. You can turn off the ability to make In-App Purchases by following these instructions: https://support.apple.com/HT201304.
APP MAINTENANCE AND SUPPORT
Apple is responsible for providing maintenance and support for Apple Apps only, or as required under applicable law. App Providers are responsible for providing maintenance and support for Third Party Apps.
APP BUNDLES
Some Apps may be sold together as a bundle (“App Bundle”). The price displayed with an App Bundle is the price you will be charged upon purchasing the App Bundle. The App Bundle price may be reduced to account for Apps you have already purchased or acquired, but may include a minimum charge to complete the App Bundle.
SEARCH RESULTS AND RANKINGS
When determining how to order the Apps in search results, the main parameters considered are the metadata provided by App Providers, how customers have engaged with the Apps and the App Store, and the popularity of the Apps in the App Store. These main parameters deliver the most relevant results to customer search queries.
LICENSED APPLICATION END USER LICENSE AGREEMENT
Apps made available through the App Store are licensed, not sold, to you. Your license to each App is subject to your prior acceptance of either this Licensed Application End User License Agreement (“Standard EULA”), or a custom end user license agreement between you and the App Provider (“Custom EULA”), if one is provided. Your license to any Apple App under this Standard EULA or Custom EULA is granted by Apple, and your license to any Third Party App under this Standard EULA or Custom EULA is granted by the App Provider of that Third Party App. Any App that is subject to this Standard EULA is referred to herein as the “Licensed Application.” The App Provider or Apple as applicable (“Licensor”) reserves all rights in and to the Licensed Application not expressly granted to you under this Standard EULA.
a. Scope of License: Licensor grants to you a nontransferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules. The terms of this Standard EULA will govern any content, materials, or services accessible from or purchased within the Licensed Application as well as upgrades provided by Licensor that replace or supplement the original Licensed Application, unless such upgrade is accompanied by a Custom EULA. Except as provided in the Usage Rules, you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute or sublicense the Licensed Application except as expressly permitted in this Agreement and, if you sell your Apple Device to a third party, you must remove the Licensed Application from the Apple Device before doing so. You may not copy (except as permitted by this license and the Usage Rules), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open-sourced components included with the Licensed Application).
b. Consent to Use of Data: You agree that Licensor may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the Licensed Application. Licensor may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.
c. Termination. This Standard EULA is effective until terminated by you or Licensor. Your rights under this Standard EULA will terminate automatically if you fail to comply with any of its terms.
d. External Services. The Licensed Application may enable access to Licensor’s and/or third-party services and websites (collectively and individually, “External Services”). You agree to use the External Services at your sole risk. Licensor is not responsible for examining or evaluating the content or accuracy of any third-party External Services, and shall not be liable for any such third-party External Services. Data displayed by any Licensed Application or External Service, including but not limited to financial, medical and location information, is for general informational purposes only and is not guaranteed by Licensor or its agents. You will not use the External Services in any manner that is inconsistent with the terms of this Standard EULA or that infringes the intellectual property rights of Licensor or any third party. You agree not to use the External Services to harass, abuse, stalk, threaten or defame any person or entity, and that Licensor is not responsible for any such use. External Services may not be available in all languages or in your Home Country, and may not be appropriate or available for use in any particular location. To the extent you choose to use such External Services, you are solely responsible for compliance with any applicable laws. Licensor reserves the right to change, suspend, remove, disable or impose access restrictions or limits on any External Services at any time without notice or liability to you.
e. NO WARRANTY: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY LICENSOR OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE LICENSED APPLICATION OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.
f. Limitation of Liability. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, CORRUPTION OR LOSS OF DATA, FAILURE TO TRANSMIT OR RECEIVE ANY DATA (INCLUDING WITHOUT LIMITATION COURSE INSTRUCTIONS, ASSIGNMENTS AND MATERIALS), BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU. In no event shall Licensor’s total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of two hundred and fifty dollars ($250.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.
g. You may not use or otherwise export or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained. In particular, but without limitation, the Licensed Application may not be exported or re-exported (a) into any U.S.-embargoed countries or (b) to anyone on the U.S. Treasury Department’s Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List. By using the Licensed Application, you represent and warrant that you are not located in any such country or on any such list. You also agree that you will not use these products for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture, or production of nuclear, missile, or chemical or biological weapons.
h. U.S. Government End Users. The Licensed Application and related documentation are “Commercial Items”, as that term is defined at 48 C.F.R. §2.101, consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation”, as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein. Unpublished-rights reserved under the copyright laws of the United States.
i. Except to the extent expressly provided in the following paragraph, this Agreement and the relationship between you and Apple shall be governed by the laws of the State of California, excluding its conflicts of law provisions. You and Apple agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, California, to resolve any dispute or claim arising from this Agreement. If (a) you are not a U.S. citizen; (b) you do not reside in the U.S.; (c) you are not accessing the Service from the U.S.; and (d) you are a citizen of one of the countries identified below, you hereby agree that any dispute or claim arising from this Agreement shall be governed by the applicable law set forth below, without regard to any conflict of law provisions, and you hereby irrevocably submit to the non-exclusive jurisdiction of the courts located in the state, province or country identified below whose law governs:
If you are a citizen of any European Union country or the United Kingdom, Switzerland, Norway or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence.
Specifically excluded from application to this Agreement is that law known as the United Nations Convention on the International Sale of Goods.
G. ADDITIONAL TERMS FOR CONTENT ACQUIRED FROM THIRD PARTIES
Some Content available in Apple Books, App Store, and Apple Podcasts (including Apple Podcasts Subscriptions) are acquired by you from the third-party provider of such Content (as displayed on the product page and/or during the acquisition process for the relevant Content), not Apple. In such case, Apple acts as an agent for the Content provider in providing the Content to you, and therefore Apple is not a party to the Transaction between you and the Content provider. However, if you are a customer of Apple Distribution International Ltd., Apple Distribution International Ltd. is the merchant of record for the Content you acquire, but such Content is licensed by the Content provider. The Content provider reserves the right to enforce the terms of use relating to such Content. The Content provider is solely responsible for such Content, any warranties to the extent that such warranties have not been disclaimed, and any claims that you or any other party may have relating to such Content.
H. ADDITIONAL APPLE MUSIC TERMS
iCloud Music Library is an Apple Music feature that allows you to access your matched or uploaded songs, playlists and music videos acquired from Apple Music, the iTunes Store or another source (“iCloud Music Library Content”) on your Apple Music-enabled devices. iCloud Music Library is turned on automatically when you set up your Apple Music membership. iCloud Music Library collects information about your iCloud Music Library Content. This information is associated with your Apple ID, and compared to iCloud Music Library Content currently available on Apple Music. iCloud Music Library Content that is not matched is uploaded to Apple’s iCloud Music Library servers (in a format determined by Apple). You can upload up to 100,000 songs. Songs acquired from the iTunes Store do not count against this limit. Songs that do not meet certain criteria (for example, excessively large files) or that are not authorized for your device are not eligible for iCloud Music Library. When you use iCloud Music Library, Apple logs information such as the tracks you play, stop or skip, the devices you use, and the time and duration of playback. You agree to use iCloud Music Library only for lawfully acquired content. iCloud Music Library is provided on an “AS IS” basis and could contain errors or inaccuracies. You should back up your data and information prior to using iCloud Music Library. If you are not an Apple Music member, you may purchase an iTunes Match subscription, which uses iCloud Music Library. When your Apple Music membership ends, you will lose access to your iCloud Music Library, including iCloud Music Library Content that is uploaded to iCloud Music Library servers.
I. ADDITIONAL APPLE FITNESS+ TERMS
Apple Fitness+ is for entertainment and/or informational purposes only and is not intended to provide any medical advice. You should always seek the advice of an appropriately qualified healthcare professional regarding (a) the safety and advisability of any given activity, or (b) any specific medical condition or symptoms.
J. CARRIER MEMBERSHIP
Where available, you may be offered to purchase a Service membership from your wireless carrier (a “Carrier Membership”). If you purchase a Carrier Membership, your carrier is the merchant of record, which means that you acquire the Service license from your carrier, which will bill you for the cost of your Service membership, but the Service is licensed and provided by Apple. K. MISCELLANEOUS TERMS APPLICABLE TO ALL SERVICES
DEFINITION OF APPLE

CONTRACT CHANGES
Apple reserves the right at any time to modify this Agreement and to add new or additional terms or conditions on your use of the Services. Such modifications and additional terms and conditions will be effective immediately and incorporated into this Agreement. Your continued use of the Services will be deemed acceptance thereof.
THIRD-PARTY MATERIALS
Apple is not responsible or liable for third party materials included within or linked from the Content or the Services.
INTELLECTUAL PROPERTY
You agree that the Services, including but not limited to Content, graphics, user interface, audio clips, video clips, editorial content, and the scripts and software used to implement the Services, contain proprietary information and material that is owned by Apple, its licensors and/or Content providers, and is protected by applicable intellectual property and other laws, including but not limited to copyright. You agree that you will not use such proprietary information or materials in any way whatsoever except for use of the Services for personal, noncommercial uses in compliance with this Agreement. No portion of the Content or Services may be transferred or reproduced in any form or by any means, except as expressly permitted by this Agreement. You agree not to modify, rent, loan, sell, share, or distribute the Services or Content in any manner, and you shall not exploit the Services in any manner not expressly authorized.
The Apple name, the Apple logo, iTunes, iTunes Store, App Store, Apple Books, Apple Music, Apple TV, Apple TV+, Apple Arcade, Apple News, Apple News+, Apple One, Apple Podcasts, Apple Fitness+, and other Apple trademarks, service marks, graphics, and logos used in connection with the Services are trademarks or registered trademarks of Apple in the U.S. and other countries throughout the world. You are granted no right or license with respect to any of the aforesaid trademarks.

APPLE DOES NOT REPRESENT OR GUARANTEE THAT THE SERVICES WILL BE FREE FROM LOSS, CORRUPTION, ATTACK, VIRUSES, INTERFERENCE, HACKING, OR OTHER SECURITY INTRUSION, AND YOU HEREBY RELEASE APPLE FROM ANY LIABILITY RELATING THERETO. WAIVER AND INDEMNITY
BY USING THE SERVICES, YOU AGREE, TO THE EXTENT PERMITTED BY LAW, TO INDEMNIFY AND HOLD APPLE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, AND LICENSORS HARMLESS WITH RESPECT TO ANY CLAIMS ARISING OUT OF YOUR BREACH OF THIS AGREEMENT, YOUR USE OF THE SERVICES, OR ANY ACTION TAKEN BY APPLE AS PART OF ITS INVESTIGATION OF A SUSPECTED VIOLATION OF THIS AGREEMENT OR AS A RESULT OF ITS FINDING OR DECISION THAT A VIOLATION OF THIS AGREEMENT HAS OCCURRED. YOU AGREE THAT YOU SHALL NOT SUE OR RECOVER ANY DAMAGES FROM APPLE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, AND LICENSORS AS A RESULT OF ITS DECISION TO REMOVE OR DENY ACCESS TO ANY INFORMATION OR CONTENT, TO SUSPEND OR TERMINATE YOUR ACCESS TO THE SERVICES, OR TO TAKE ANY OTHER ACTION DURING THE INVESTIGATION OF A SUSPECTED VIOLATION OR AS A RESULT OF APPLE’S CONCLUSION THAT A VIOLATION OF THIS AGREEMENT HAS OCCURRED. THIS WAIVER AND INDEMNITY PROVISION APPLIES TO ALL VIOLATIONS DESCRIBED IN OR CONTEMPLATED BY THIS AGREEMENT.
STATUTORY EXCEPTIONS FOR PUBLIC INSTITUTIONS
If you are a qualified public educational or government institution and any part of this Agreement, such as, by way of example, all or part of the indemnification section, is invalid or unenforceable against you because of applicable local, national, state or federal law, then that portion shall be deemed invalid or unenforceable, as the case may be, and instead construed in a manner most consistent with applicable governing law.
GOVERNING LAW
Except to the extent expressly provided in the following paragraph or to the extent required by applicable law, this Agreement and the relationship between you and Apple, and all Transactions on the Services shall be governed by the laws of the State of California, excluding its conflicts of law provisions. You and Apple agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, California, to resolve any dispute or claim arising from this Agreement. If (a) you are not a U.S. citizen; (b) you do not reside in the U.S.; (c) you are not accessing the Service from the U.S.; and (d) you are a citizen of one of the countries identified below, you hereby agree that any dispute or claim arising from this Agreement shall be governed by the applicable law set forth below, without regard to any conflict of law provisions, and you hereby irrevocably submit to the non-exclusive jurisdiction of the courts located in the state, province or country identified below whose law governs:
If you are a citizen of any European Union country or the United Kingdom, Switzerland, Norway or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence.
Specifically excluded from application to this Agreement is that law known as the United Nations Convention on the International Sale of Goods.
OTHER PROVISIONS
This Agreement constitutes the entire agreement between you and Apple and governs your use of the Services, superseding any prior agreements with respect to the same subject matter between you and Apple. You also may be subject to additional terms and conditions that may apply when you make Transactions or use affiliate services, third-party content, third-party software, or additional services such as the Volume Purchase Program. If any part of this Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect. Apple’s failure to enforce any right or provisions in this Agreement will not constitute a waiver of such or any other provision. Apple will not be responsible for failures to fulfill any obligations due to causes beyond its control.
You agree to comply with all local, state, federal, and national laws, statutes, ordinances, and regulations that apply to your use of the Services. Your use of the Services may also be subject to other laws. Risk of loss for all electronically delivered Transactions pass to the acquirer upon electronic transmission to the recipient. No Apple employee or agent has the authority to vary this Agreement.
Apple may notify you with respect to the Services by sending an email message to your email address or a letter via postal mail to your mailing address, or by a posting on the Services. Notices shall become effective immediately. Apple may also contact you by email or push notification to send you additional information about the Services.
You hereby grant Apple the right to take steps Apple believes are reasonably necessary or appropriate to enforce and/or verify compliance with any part of this Agreement. You agree that Apple has the right, without liability to you, to disclose any data and/or information to law enforcement authorities, government officials, and/or a third party, as Apple believes is reasonably necessary or appropriate to enforce and/or verify compliance with any part of this Agreement (including but not limited to Apple’s right to cooperate with any legal process relating to your use of the Services and/or Content, and/or a third-party claim that your use of the Services and/or Content is unlawful and/or infringes such third party’s rights).

Wszelkie prawa, które nie zostały wyraźnie udzielone Użytkownikowi w tej Umowie, pozostają prawami YouTube lub ich odpowiednich posiadaczy. Oznacza to na przykład, że korzystanie z Usługi nie daje Użytkownikowi żadnych praw własności intelektualnej do dostępnych Treści (w tym do jakiejkolwiek marki użytej lub wyświetlonej w Usłudze).
Rozwijanie, ulepszanie i aktualizowanie Usługi
YouTube stale zmienia i ulepsza Usługę. W ramach nieustannego rozwoju naszych treści i usług cyfrowych możemy wprowadzać w nich modyfikacje lub zmiany (we wszystkich elementach Usługi), np. dodajemy lub usuwamy różne funkcje, wprowadzamy nowe treści i usługi cyfrowe lub wycofujemy stare. Nie może jednak przesyłać do Usługi Treści, które nie są zgodne z tą Umową lub przepisami prawa. Na przykład przesyłane Treści nie mogą zawierać materiałów chronionych prawem własności intelektualnej osób trzecich (takim jak prawo autorskie), chyba że Użytkownik otrzymał od nich upoważnienie lub jest do tego prawnie upoważniony (w tym w drodze wszelkich dostępnych wyjątków lub ograniczeń dotyczących praw autorskich lub praw pokrewnych przewidzianych w prawie Unii Europejskiej). Użytkownik jest prawnie odpowiedzialny za Treści przesłane do Usługi. Możemy korzystać z automatycznych systemów analizujących Treści, aby wykrywać naruszenia i nadużycia, takie jak spam, złośliwe oprogramowanie i nielegalne treści.

Czas trwania licencji

Prawo do zarabiania
Użytkownik udziela YouTube prawa do zarabiania na należących do niego Treściach w Usłudze (zarabianie może obejmować wyświetlanie reklam przy albo w Treściach lub pobieranie od użytkowników opłaty za dostęp). Ta Umowa nie uprawnia użytkownika do otrzymywania żadnych płatności. Od 1 czerwca 2021 r. wszelkie płatności, jakie użytkownik będzie miał prawo otrzymywać od YouTube na podstawie jakiejkolwiek innej umowy pomiędzy użytkownikiem a YouTube (na przykład w ramach programu partnerskiego YouTube, wspierania kanału lub superczatu), będą traktowane jako tantiemy. Jeśli wymaga tego prawo, Google będzie pobierać podatki od tych płatności.
Usuwanie Treści przez Użytkownika
Użytkownik może w każdej chwili usunąć Treści z Usługi. Użytkownik może też utworzyć kopię swoich Treści przed ich usunięciem.Użytkownik musi usunąć Treści, jeśli stracił prawa wymagane na mocy niniejszych warunków.
Usuwanie Treści Użytkownika przez YouTube
Jeśli zasadnie uznamy, że jakakolwiek Treść Użytkownika (1) narusza postanowienia tej Umowy (2) lub może wyrządzić szkodę YouTube, naszym użytkownikom lub osobom trzecim, zastrzegamy sobie prawo do usunięcia niektórych lub wszystkich takich Treści. Użytkownik zostanie powiadomiony o przyczynach naszego działania, chyba że zasadnie będziemy uważać, że: (a) złamie to przepisy prawa lub wytyczne organu egzekwującego prawo lub w inny sposób narazi YouTube lub nasze Podmioty stowarzyszone na ryzyko związane z odpowiedzialnością prawną; (b) zagrozi procesowi sprawdzania zagrożeń lub integralności albo działaniu Usługi; lub (c) wyrządzi szkodę jakiemukolwiek użytkownikowi, osobie trzeciej, YouTube lub Podmiotowi stowarzyszonemu YouTube. Jeśli Użytkownik stwierdzi, że ostrzeżenie zostało przyznane w wyniku pomyłki, może się odwołać tutaj.
Jeśli funkcjonalność kanału Użytkownika została ograniczona w wyniku ostrzeżenia, nie może on korzystać z innego kanału, aby obejść te ograniczenia. Nieprzestrzeganie tego zakazu jest istotnym naruszeniem tej Umowy i Google zastrzega sobie prawo do tego, aby zamknąć konto Google Użytkownika lub ograniczyć jego dostęp do części lub całości Usługi.
Ochrona praw autorskich
Udostępniamy informacje ułatwiające właścicielom praw autorskich zarządzanie ich własnością intelektualną online w naszym Centrum praw autorskich YouTube. Jeśli uważasz, że Twoje prawa autorskie zostały naruszone w naszej Usłudze, możesz nas o tym powiadomić.

Zamknięcie i zawieszenie konta przez YouTube z uzasadnionych powodów
YouTube zastrzega sobie prawo do zawieszenia lub zamknięcia konta Użytkownika bądź zawieszenia lub zablokowania dostępu Użytkownika do całej Usługi lub jej części, jeśli (a) Użytkownik wielokrotnie lub w istotny sposób naruszy tę Umowę, (b) jest to wymagane do zachowania zgodności z przepisami prawa lub wykonania nakazu sądowego, lub (c) mamy uzasadniony powód, by uważać, że doszło do zachowania, które skutkuje powstaniem zobowiązań lub szkody wobec dowolnego Użytkownika, osoby trzeciej, YouTube lub naszych Podmiotów stowarzyszonych.
Powiadomienie o rozwiązaniu lub zawieszeniu konta
YouTube powiadomi Użytkownika o przyczynie zamknięcia lub zawieszenia konta, chyba że będziemy mieli uzasadnione powody, by uważać, że: (a) naruszy to przepisy prawa lub wytyczne organu egzekwującego prawo; (b) zagrozi procesowi sprawdzania zagrożeń; (c) zagrozi integralności,działaniu lub bezpieczeństwu Usługi; lub (d) wyrządzi szkodę jakiemukolwiek użytkownikowi, osobie trzeciej, YouTube lub naszemu Podmiotowi stowarzyszonemu.

Licencja ta ma na celu wyłącznie umożliwienie Użytkownikowi korzystania z Usługi świadczonej przez YouTube w sposób dozwolony tą Umową. Użytkownikowi nie wolno kopiować, modyfikować, rozpowszechniać, sprzedawać ani dzierżawić żadnej części oprogramowania, nie wolno mu też analizować wstecznie ani podejmować prób wyodrębnienia jego kodu źródłowego, chyba że prawo zabrania stosowania tego typu ograniczeń lub Użytkownik uzyskał pisemną zgodę YouTube..
Oprogramowanie typu open source

Użytkownicy biznesowi: Jeśli Użytkownik korzysta z Usługi, żeby prowadzić działalność handlową, biznesową, rzemieślniczą lub zawodową („Użytkownik biznesowy”), w zakresie dopuszczalnym przez przepisy prawa, poniższe ograniczenia odpowiedzialności również będą miały zastosowanie:

Usługa może zawierać linki do stron i usług internetowych, które nie są własnością YouTube ani nie są przez YouTube kontrolowane. YouTube nie ma żadnej kontroli nad takimi stronami oraz usługami internetowymi i nie bierze za nie żadnej odpowiedzialności. Użytkownik powinien mieć tego świadomość, kiedy opuszcza Usługę. Zalecamy Użytkownikowi zapoznanie się z zasadami i polityką prywatności każdej odwiedzanej witryny i usługi internetowej należącej do osoby trzeciej.
Informacje o Umowie
Zmiany w Umowie

Kontynuacja Umowy

Nieprzestrzeganie warunków
Jeśli Użytkownik nie będzie przestrzegać postanowień tej Umowy, a my nie podejmiemy natychmiast odpowiednich działań, nie oznacza to, że rezygnujemy z jakichkolwiek przysługujących nam praw (na przykład prawa do podjęcia działań w przyszłości).
Prawo właściwe
Jeśli miejsce zamieszkania Użytkownika znajduje się w obrębie Europejskiego Obszaru Gospodarczego lub Szwajcarii, ta Umowa oraz relacja z YouTube na mocy tej Umowy podlegają przepisom prawa kraju zamieszkania Użytkownika. Użytkownik może wszczynać postępowania sądowe w sądach miejscowych.
Instrukcje dotyczące odstąpienia od umowy w Europejskim Obszarze Gospodarczym
Konsumentom z Europejskiego Obszaru Gospodarczego od 28 maja 2022 r. w ramach przepisów prawa ochrony konsumentów obowiązujących w EOG przysługuje prawo do odstąpienia od tej umowy, jak opisano w poniższym wzorze pouczenia o odstąpieniu od umowy w Unii Europejskiej.
Prawo do odstąpienia od umowy
Użytkownik ma prawo odstąpić od niniejszej umowy w terminie 14 dni bez podania jakiejkolwiek przyczyny.
